UT sued after looking to expel senior for alleged sexual assault

The University of Texas at Austin is being sued for seeking to expel a student regarding a claim that he sexually assaulted a non-UT student. 

The student, a senior, one semester away from graduating with a Physics degree, has had no criminal charges filed against him concerning the assault, nor has the victim, a female student who does not attend UT, filed an official complaint.

Both students were at a house party at sometime around March 2015 where alcohol was involved, and both were extremely inebriated before returning to the girl’s apartment later that night. A female friend followed along and ended up having sexual intercourse with the man that same night, in the same bed that the alleged victim was asleep on.

The next morning, after having fallen to the ground, the girl crawled back into bed, and she and the male student began to touch each “suggestively.” The female friend, who had heard the girl verbally and physically responding to the man, left the room to give the two some privacy. Both eyewitnesses believed that she was conscious the entire time.

The man said that the girl confided to him that she had previously starred in some pornographic videos, and that she also had a girlfriend.

Later that day, in a text message, the girl texted her female friend and claimed that she was, in fact, unconscious during their intercourse. However, she has yet to file any charges against him.

About a month later, the University of Texas underwent an investigation following a phone call to the police from the girl’s father. The phone call was directed to the dean of the University, which led to a Title IX investigation of the assault.

The man was not notified of his consideration for expulsion until November 2015. The institutional rules of the university stipulate that they can expel a student even without proof of the alleged crime.

The court case is still ongoing and there have been no further updates on the student’s expulsion.
